Resumen
In a judgment dated August 1, 2024, Justice Jacobs addressed a key topic in English and Welsh law: arbitrators' disclosure obligations under the Arbitration Act 1996. In Aiteo v. Shell Western Supply, the court revisited the scope of disclosure, building on the UK Supreme Court’s Halliburton v. Chubb ruling. This judgment also touches on issues that will influence the application of the new Arbitration Act 2025. It is argued that, while relevant under English and Welsh law, this case may also guide interpretation of disclosure provisions in Mexican law to foster greater transparency from arbitrators.
